IMPORTANT: READ CAREFULLY:

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Adrián Toledano O'Farrill and Sergio Sandoval Vizcaino for the Cozumel Screen Saver, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation.

Any software provided along with the Cozumel Screen Saver that is associated with a separate end-user license agreement is licensed to you under the terms of that license agreement.

By installing, copying, downloading, accessing or otherwise using the Cozumel Screen Saver, you agree to be bound by the terms of this EULA.

1.- License Grant: You are granted a non-exclusive license to use one copy of the Cozumel Screen Saver for your own personal use on a single computer. A license for the Cozumel Screen Saver may not be shared or used concurrently on different COMPUTERS.

2.- Ownership: All of the material on the Cozumel Screen Saver is protected by Copyrights.

3.- Restrictions.

Separation of Components.

The Cozumel Screen Saver is licensed as a single product. Its component parts may not be separated for use on more than one computer. You may not modify, adapt or create derivative works based on the Cozumel Screen Saver.

Duplication and distribution.

You may not make copies of the Cozumel Screen Saver on any other storage device regardless of the storage technology except as expressly provided in this End User License Agreement. You may not copy, reproduce, or distribute the Cozumel Screen Saver or any of its contents through any network system, or through any computer subscriber service, bulletin board system, intranet, extranet system, or by any other means. You may not copy, reproduce, or distribute the Cozumel Screen Saver or any of its contents through the Internet. You may not copy, reproduce, or distribute the Cozumel Screen Saver or any of its contents through the World Wide Web.

Rental.

You may not rent, lease or lend the Cozumel Screen Saver.

Trademarks.

This End User License Agreement does not grant you any rights in connection with any trademarks or service marks.

4.- Backup Copy: You may make one copy of the Cozumel Screen Saver solely for backup or archival purposes. You may not otherwise make copies of the Cozumel Screen Saver or the printed materials accompanying the Cozumel Screen Saver, except as expressly provided in this End User License Agreement.

5. Copyright: All title and intellectual property rights in and to the Cozumel Screen Saver (including but not limited to any images, photographs, animations, video, audio, music, and text, incorporated into the Cozumel Screen Saver), the accompanying printed materials, and any copies of the Cozumel Screen Saver are owned by Adrián Toledano O'Farrill, Sergio Sandoval Vizcaino or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the Cozumel Screen Saver is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This End User License Agreement grants you no rights to use such content. All rights not expressly granted are reserved by Adrián Toledano O'Farrill and Sergio Sandoval Vizcaino.

6. Warranty: The Cozumel Screen Saver is offered, "as is" and without warranties as to performance, functionality, merchantability or any other warranties whether expressed or implied. In the event applicable law imposes any implied warranties, the implied warranty period is limited to ninety (90) days from the date of receipt. Some jurisdictions do not allow such limitations on duration of an implied warranty, so the above limitation may not apply to you.

7.- Customer Remedies:The Cozumnel Screen Server is provided "as is", There are no consumer remedies nor support services.

NO OTHER WARRANTIES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADRIAN TOLEDANO O'FARRILL, SERGIO SANDOVAL VIZCAINO AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE COZUMEL SCREEN SAVER, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.

8.- LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADRIAN TOLEDANO O'FARRILL AND SERGIO SANDOVAL VIZCAINO OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE COZUMEL SCREEN SAVER OR THE FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF ADRIAN TOLEDANO O'FARRILL OR SERGIO SANDOVAL VIZCAINO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, ADRIAN TOLEDANO O'FARRILL AND SERGIO SANDOVAL VIZCAINO ENTIRE LIABILITY UNDER ANY PROVISION OF THIS END USER LICENSE AGREEMENT SHALL BE LIMITED TO THE LOWER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT OR U.S.$0.01 (1/100 U.S DOLLAR). BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
